These terms and conditions govern the relationship between LES STUDIOS DU CHATEAU SAS with share capital of €15,000, with its registered office located at 226 rue Saint Denis 75002 PARIS - entered in the commercial register of PARIS - FRANCE under number 492 134 424 hereinafter referred to as “PASCALE MONVOISIN” the Seller, and the Internet user wishing to place an order hereinafter referred to as the “Customer”. These General Terms and Conditions of Sale apply without restrictions or reservations to all “PASCALE MONVOISIN” sales, including products sold through the electronic catalogue on the pascalemonvoisin.com internet site as well as through distance selling. .

 

PRODUCTS

We would like to inform the Customer that product images may be slightly different from the actual item due to the Customer’s monitor display or the lighting used during the photo shoot. In addition, as it concerns hand-crafted creations, the articles may present finishing irregularities, differences in size and/or colour of the stones inherent to this type of manufacture which cannot be considered to be major defects. The liability of the Company cannot be called into question nor can the validity of the order be affected. The photographs, artwork, and descriptions of the products for sale are indicative only and shall in no way be binding upon the Company. ORDERS

The Customer declares having read and accepted these Terms and Conditions before placing the order. Validating the order implies express acceptance by the customer of the Terms and Conditions. After having verified the content of the order, the Customer will then definitively confirm the order at the payment stage. This confirmation is tantamount to entering into a contract. Once the contract has been entered into, the Company will send a summary of the information on the order form by email to the Customer. The invoice will also be provided in an attachment to the email sent to the Customer. Delivery will take place within a maximum of 30 days. The terms and conditions for entering into a contract on the pascalemonvoisin.com site have been drawn up in French and English. To the extent that if there is any inconsistency between the French language version and the English language version, the French version will prevail.

 

PAYMENT

It should be noted that validating an order obliges the Customer to pay the indicated price. The Customer may only pay for purchases using a bank card. Accepted bank cards include: CB, MasterCard®, Visa®, American Express®. At the time of payment, the bank will request personal information from the Internet user to verify the identity of the card holder and to validate the transaction. The Customer will need to provide the number of the bank card, and depending on the type of card, the expiration date as well as the Card Security Code (the three-digit code on the back of the card). Upon validating the order form, the Customer ensures the Company that he or she is in good standing with the issuer of the bank card. The card will be debited immediately.

 

RIGHT OF WITHDRAWAL

Pursuant to the provisions of Articles L221-18 et seq. of the French Consumer Code, the Customer shall be entitled to a withdrawal period of 14 days without having to provide any reason whatsoever. The 14-day withdrawal period commences from the date the Customer receives the ordered item. To exercise this right of withdrawal, the Customer will download the attached withdrawal form with the contract, and mail it to the following address: Les Studios du Château PASCALE MONVOISIN SHOWROOM - 226, rue Saint-Denis - 75002 Paris FRANCE, or send an email to eshop@pascalemonvoisin.com with the copy of the invoice. The product in question must be returned at the same time as the right to withdraw is exercised and sent by mail to SHOWROOM PASCALE MONVOISIN - 226 rue Saint Denis / 75002 Paris - France (with the postmark being authoritative). The costs for returning the product(s) shall be borne by PASCALE MONVOISIN. Within 14 business days from the moment the Company is informed of the Customer’s decision to exercise a right of withdrawal, the Company shall refund the amount received in payment for the product which is the subject of withdrawal. The refund period may be extended until the product returned by the Customer has been received and verified. However, it should be noted that any refunds for jewellery may only be made if all of the following conditions are met: 1) The product has not been worn, used, modified or damaged, nor has it undergone any changes that could result in it not being able to be resold as brand new. 2) The product was not custom-made 3) The product must be returned in its original packaging together with its invoice

 

RETURNS / AFTER-SALES SERVICE

Defective products may be returned by the Customer to the after-sales service department. Before sending us the product, the Customer agrees to send an email to sav@pascalemonvoisin.com with a photo of the damaged piece of jewelry accompanied by the invoice and a description of how it was damaged to enable us to assess whether the product is able to be repaired. “PASCALE MONVOISIN” will then send you an email confirming whether the product can be repaired or exchanged and whether you can return the product or not. The customer may return the item of jewellery along with the completed form to the address shown on the form. It shall be the Customer’s responsibility to retain all proof of return which means that the articles shall be returned by any means that provide an exact date of this return. The costs, risks and perils of returning merchandise shall be borne by the Customer (it is therefore advisable to declare the value of the merchandise and to take out insurance covering these risks). It is also advisable to return the merchandise using registered mail. Merchandise should be returned to the following address: SHOWROOM PASCALE MONVOISIN 226, rue Saint-Antoine, 75002 Paris - FRANCE Upon receipt of the returned product in the after-sales department, and if the product is able to be repaired or exchanged, “PASCALE MONVOISIN” will send the product back to you within 2 to 3 weeks save in exceptional cases where the repair would require more time. In the event the defective product that was returned to “PASCALE MONVOISIN” could not be repaired, an identical product will be sent if there is one in the catalogue, or a refund will be made if a repair cannot be made. These provisions only apply in the event of an existing defect and do not apply where the defect is the result of mishandling or any other action detrimental to the product on the part of the Customer.

 

INTELLECTUAL PROPERTY

The Site is the property of the Company. The Site is protected under national laws and international treaties relating to copyright. All rights relating to the Site and the overall concept of the Company’s activities and their original and innovative nature, including, but not limited to, intellectual property rights to the textual elements, literary, artistic, graphic (including photographs) and audiovisual creations, IT and HTML development and other intellectual work and, more broadly, any creations that could be protected by intellectual property rights such as images, logos, layout, graphic components, structure, ergonomics, colour codes, typography, fonts, basic graphic elements, graphic display organisation, page setting, background images, the Site’s visual identity, belong to the Company or are used by the Company on an ongoing basis without limitation. The Customer undertakes to not infringe upon, either directly or indirectly, the Company, the Site or the rights of the Company.

 

GOVERNING LAW

This contract is governed by French law. The Courts having jurisdiction are the Tribunaux de Paris (France).

 

 

PERSONAL DATA

Under the terms of Act N° 78-17 dated 6 January 1978 on information technology, data files and civil liberties, the handling of nominative data collected on the site is declared to the French Data Protection Authority (CNIL). Users have the right to access, modify, correct and delete their personal data. To exercise this right, the user should send an email to the customer service department of PASCALE MONVOISIN. Users should include their last name, first name, address, any user identification number and attach a copy of an identity document. Lastly, PASCALE MONVOISIN may share nominative data with its trading partners. As a result, users may receive sales offers from third parties. However, the user’s email address may be provided to those trading partners unless otherwise stipulated by the User. As a matter of course, Users may refuse such disclosure by expressing their refusal by letter or email, in accordance with the above paragraph. Some web pages may sometimes contain electronic images or “web beacons”, making it possible to count the number of visitors viewing the page. These web beacons might be used by our partners, mainly to measure and improve the effectiveness of some of the advertising. In any event, the information obtained via these beacons is anonymous and merely used to collect data on how often certain site pages are visited, with the aim of better serving Users to our site.
