Terms and conditions of use
1. Scope of the terms and conditions of use These terms and conditions of use govern the use made of the Website by internet users when accessing, visiting, browsing, creating an account, placing orders or more generally using the Website (hereinafter referred to as "User(s)"). By browsing the Website and carrying out actions on it, the User acknowledges that they have read these terms and conditions of use and accepts them unreservedly. PASCALE MONVOISIN reserves the right to amend these terms and conditions of use at any time. These terms and conditions of use are complemented by the Personal Data Protection Policy, the Cookie management tool, and the Website terms and conditions of sale. Website Users may view these documents at any time by clicking on the links at the bottom of each page on the Website and printing them if required.

2. Access to the website The User is personally responsible for implementing the computing, technical, network and telecommunication resources required in order to access the Website as well as the expertise required in order to use the Internet and access the Website. The User is responsible for the connection and equipment costs associated with accessing the Internet and using the Website. The User accesses and uses the Website at their own risk and peril. Attempting to gain unauthorised access to the Website services, accessing the Website or maintaining connection via any means other than the interface expressly provided to the User by PASCALE MONVOISIN is prohibited. The Site is usually accessible to the User at all times. However, PASCALE MONVOISIN may decide to interrupt the service for technical maintenance, and will in this case attempt to advise the User in advance of the dates and times affected.

3. Description of services The aim of the Website is to offer PASCALE MONVOISIN products for sale online. The Website may also provide details about the PASCALE MONVOISIN brand, process, partnerships and projects. The publishing team strives to provide details on the Website that are as accurate as possible. However, it cannot be held responsible for any omissions, inaccuracies or oversights in updates, either a result of its own actions or those of third party partners providing these details. 4. Creating and managing the customer account To place an order, the User is invited to create a customer account ("Customer Account"). Creating any customer account is free and managed by PASCALE MONVOISIN. By accessing their customer account, the User can: - manage their details (identification data, delivery and/or billing addresses); - place orders for products, manage their purchasing basket; - view current orders, order history and other associated services. The User undertakes to ensure that any data they enter is correct, up to date and does not infringe the rights of third parties. Customer Account identification data comprises the email address provided by the User, as well as an automatically generated password. These login details, particularly the password, are personal and confidential. The User is solely responsible for their use, such that any connection to their Customer Account will be presumed to be made by the User. In the event of a password being lost or stolen, or even suspected to have been lost or stolen, the User should immediately create a new password by clicking on "forgotten your password?" in the "login" space, or alert PASCALE MONVOISIN if this is not possible.

5. User behaviour Each User undertakes to use the Website, including their Customer Account, in a responsible, respectful and courteous way towards third parties and PASCALE MONVOISIN. As such, by accessing the Website (including their private area), the User must refrain in particular from: - any deed they are not permitted to carry out in accordance with applicable regulations and laws; - uploading and/or displaying content to the Website unless previously authorised by PASCALE MONVOISIN; - disrupting or interrupting the operation of the Website or the servers or networks connected to the Website; - attempting to cause harm to any other User, the Website host or network, including in particular exposing the Website to a virus, saturating its bandwidth, inundating the server, etc.; - accessing data not intended for the User, or entering a server/Customer Account to which the User does not have authorised access; - attempting to probe, scan or test the vulnerability of a system, particularly of the Website or a network, or to contravene the security or authentication measures without having obtained permission; - stealing the identity of another person, particularly of another User; - transmitting or transferring (by any means) any information or software derived from the Application, particularly to other countries or certain foreign nationals in violation of a national or international law or regulation. 6. Industrial and intellectual property The elements of the Website and the products presented are the property of PASCALE MONVOISIN and/or its partners. Some of these elements (such as software, databases, photographs, illustrations, texts, graphic components or combinations of these elements) may be protected by intellectual property rights, particularly copyright and trademark law. Disclosure of these elements must not be interpreted as granting any licence to these elements, or any other right other than viewing the Website for personal use. Any reproduction in whole or in part of the Website or its elements without prior written permission from the author (i.e. PASCALE MONVOISIN) may lead to the offender being prosecuted.

PASCALE MONVOISIN limitation of liability PASCALE MONVOISIN undertakes to ensure the Website is functioning correctly, however it cannot be held liable for any direct or indirect inconvenience or damage that the User could incur due to using the Website, or for any inconvenience or damage inherent to the use of the Internet, in particular a breakdown in service, external intrusion or the presence of computer viruses. In addition, PASCALE MONVOISIN cannot be held responsible for indirect damage (such as a lost opportunity, for example) resulting from using the Website.

Validity of the terms and conditions of use If one or more provisions of the terms and conditions of use are held to be invalid or declared as such under a law, a regulation or following a definitive decision by a competent court, the other stipulations shall retain their full force and scope. In the event of difficulties of interpretation between any of the provision headings and any of the clauses, the headings shall be disregarded and the content of the clause in question shall take precedence.

13. Consequences in the event of the User failing to comply PASCALE MONVOISIN may cancel the User's right to use the Website due to any conduct that contravenes these terms and conditions of use.
